This website is owned and operated by Amber Wood (“Amber Wood,” “I,” “me,” or “my”). The terms “you,” “your,” and “user” refer to website visitors, customers, clients, members, participants, and other users of the website and related services.

Throughout these Terms, iamberwood.com and the information, content, products, programs, memberships, communities, digital resources, events, and services made available through or in connection with it may collectively be referred to as the “Site” or “Services.”

Please read these Terms carefully before using the Site or Services. By accessing or using any portion of the Site or Services, you acknowledge that you have read, understood, and agreed to these Terms and any policies incorporated by reference.

If you do not agree with these Terms, do not access or use the Site or Services.

Amber Wood is not acting as your physician, psychologist, psychiatrist, therapist, attorney, financial advisor, or other licensed professional by providing the Site or Services.

The Site and Services are not intended to diagnose, treat, cure, or prevent any medical or mental-health condition and are not substitutes for individualized care from an appropriately qualified professional.

Content discussing grief, loss, pleasure, embodiment, nervous-system awareness, breathwork, somatic practices, relationships, personal development, or related subjects is educational in nature and should not be interpreted as diagnosis or treatment.

You are responsible for determining whether a practice, program, resource, or Service is appropriate for you. If you have questions or concerns regarding your physical or mental health, consult an appropriately licensed healthcare professional.

If you are experiencing a medical or mental-health emergency, contact appropriate emergency services or a qualified healthcare provider.


4. SOMATIC, BREATHWORK, EMBODIMENT, AND MOVEMENT PRACTICES

Certain Services may include breathwork, meditation, body awareness, movement, somatic exercises, embodiment practices, or other experiential activities.

Participation in these activities is voluntary.

You acknowledge that physical and experiential practices may affect people differently and that you are responsible for listening to your body, modifying or discontinuing a practice when appropriate, and obtaining professional medical guidance before participating if you have a medical condition, injury, are pregnant, take medication that may affect participation, or otherwise have concerns about whether a practice is appropriate for you.

You agree to participate within your own abilities and assume responsibility for your voluntary participation to the fullest extent permitted by law.


5. PURCHASES AND PAYMENT

When you purchase a product or Service, you agree to provide accurate and current billing and payment information.

Prices are displayed at the time of purchase and may change without notice. Price changes do not retroactively alter completed purchases unless otherwise stated.

Payments may be processed by third-party payment processors. Your use of those services may also be subject to the processor's terms and privacy policies.

I reserve the right to refuse, cancel, or limit an order where reasonably necessary, including in cases of pricing errors, suspected fraud, unauthorized transactions, technical errors, or violations of these Terms.


6. REFUNDS AND CANCELLATIONS

Refund and cancellation terms may vary depending upon the product, program, membership, event, or Service purchased.

Any refund or cancellation policy presented on a sales page, checkout page, enrollment agreement, membership agreement, or other purchase-specific document at the time of purchase is incorporated into these Terms and governs that purchase.

Unless a different policy is expressly stated at the time of purchase, requests regarding billing, cancellations, or refunds should be submitted to billing@iamamberwood.com.

Certain digital products, downloadable resources, recordings, immediately accessible materials, completed services, or other offerings may be non-refundable where disclosed at or before purchase and permitted by applicable law.

Nothing in these Terms limits any refund, cancellation, or consumer right that cannot legally be waived.


7. CHARGEBACKS AND PAYMENT DISPUTES

If you believe a charge was made incorrectly, you agree to make a good-faith effort to contact billing@iamamberwood.com so the issue can be investigated and, where appropriate, resolved.

Fraudulent, abusive, or knowingly false payment disputes or chargebacks may constitute a violation of these Terms.

Nothing in this provision prevents you from exercising legitimate rights available through your financial institution, card issuer, payment provider, or applicable law.


8. ACCOUNTS AND MEMBERSHIPS

Certain Services may require you to create an account or membership profile.

You agree to provide accurate information and keep your account information current.

You are responsible for protecting your login credentials and may not share account access with unauthorized persons.

Purchases, memberships, accounts, programs, and digital products are for the registered purchaser's individual use unless expressly stated otherwise.

If you believe your account has been compromised, notify support@iamamberwood.com promptly.

I reserve the right to suspend or terminate accounts used fraudulently, unlawfully, abusively, or in violation of these Terms.


9. COMMUNITY PARTICIPATION

Certain Services may include online communities, group programs, discussions, live gatherings, or other spaces where participants interact with one another.

Participation requires respectful conduct.

You may not use community spaces to harass, threaten, discriminate against, exploit, intimidate, or deliberately harm other participants; solicit participants without authorization; distribute spam; disclose another participant's private information; or engage in unlawful conduct.

Because community spaces involve other participants, I cannot guarantee that information you voluntarily share will remain confidential. You are responsible for deciding what personal information you choose to disclose.

I reserve the right to moderate content and remove participants whose conduct violates community guidelines or these Terms.


10. INTELLECTUAL PROPERTY

Unless otherwise stated, the Site and Services and the original content made available through them are owned by Amber Wood or used with permission and are protected by applicable copyright, trademark, and other intellectual-property laws.

This includes, without limitation, original text, graphics, photographs, videos, audio recordings, designs, downloads, frameworks, methodologies, exercises, worksheets, assessments, program materials, course materials, community materials, presentations, and other proprietary content.

The names and marks associated with Amber Wood's proprietary offerings include, among others:

Use of the ™ symbol reflects a claim of trademark rights. Nothing contained on the Site or within the Services grants you ownership of Amber Wood's intellectual property.

Access to or purchase of any proprietary material grants you a limited, revocable, non-exclusive, non-transferable license for your personal, non-commercial use only. No ownership rights are transferred to you. Except with prior express written permission, you may not reproduce, copy, modify, publish, distribute, transmit, display, sell, sublicense, teach, commercially exploit, create derivative works from, or otherwise use Amber Wood's proprietary materials, methodologies, frameworks, curriculum, program structures, exercises, assessments, or other protected content.

You may not use Amber Wood's proprietary materials, methodologies, frameworks, curriculum, program structures, exercises, assessments, terminology, or other protected content to develop, recreate, market, teach, sell, license, or provide a competing or substantially similar program, course, coaching service, certification, training, workshop, membership, methodology, framework, or other commercial offering.

You may not upload or provide Amber Wood's proprietary materials to artificial intelligence, machine-learning, or content-generation systems for the purpose of reproducing the materials, generating derivative or substantially similar materials, developing competing intellectual property or commercial offerings, or training such systems on the materials. 

You may not systematically extract, deconstruct, reproduce, or reverse engineer proprietary programs, methodologies, frameworks, assessments, curriculum, or materials for the purpose of recreating their structure, methodology, sequencing, instructional design, or commercial application. 

Unauthorized use may result in termination of access without refund and may result in legal action where appropriate.


11. USER-SUBMITTED CONTENT

If you voluntarily submit comments, testimonials, reviews, photographs, written responses, or other materials for publication or promotional use, any rights granted regarding that material will be governed by the permission, release, agreement, or authorization associated with the submission.

Participation in a program or community does not, by itself, grant permission for your private story, image, likeness, or personal information to be publicly used for marketing purposes.


12. COPYRIGHT INFRINGEMENT

I respect the intellectual-property rights of others and expect users of the Site and Services to do the same.

I do not guarantee any particular personal, emotional, relational, professional, financial, health, healing, grief-related, or other outcome from using the Site, participating in a program, implementing a practice, purchasing a product, or engaging with any Service.

Testimonials, examples, stories, and participant experiences are illustrative and do not constitute promises that you will achieve the same or similar results.

You remain responsible for your decisions, actions, participation, and results.


17. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AMBER WOOD SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR ACCESS TO OR USE OF THE SITE OR SERVICES.

TO THE FULLEST EXTENT PERMITTED BY LAW, IF LIABILITY IS ESTABLISHED, AMBER WOOD'S AGGREGATE LIABILITY ARISING FROM A PARTICULAR PRODUCT OR SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THAT PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

Some jurisdictions do not permit certain exclusions or limitations of liability. In those jurisdictions, these limitations apply only to the fullest extent permitted by law.


18. INDEMNIFICATION

To the fullest extent permitted by law, you agree to indemnify and hold Amber Wood harmless from claims, losses, liabilities, damages, expenses, and reasonable attorneys' fees arising from your unlawful use of the Site or Services, your violation of these Terms, or your infringement of another person's rights.

This provision does not require indemnification for conduct for which indemnification cannot lawfully be required.

The Privacy Policy is incorporated into these Terms by reference.


20. CHANGES TO SERVICES AND PRICES

Prices, offerings, features, and Services may change from time to time.

I reserve the right to modify or discontinue products or Services, provided that existing contractual commitments and rights under applicable law will be honored.

I am not liable for prospective changes to offerings, pricing, availability, or features except where otherwise required by law or an applicable agreement.


21. TERMINATION

I reserve the right to suspend or terminate access to the Site or Services when reasonably necessary because of a material violation of these Terms, unlawful activity, fraud, harassment, abuse, misuse of intellectual property, threats to the security of the Site or its users, or nonpayment.

Provisions that by their nature should survive termination, including intellectual-property protections, disclaimers, limitations of liability, dispute provisions, and payment obligations, will survive termination.


22. GOVERNING LAW; VENUE; MEDIATION

These Terms shall be construed in accordance with and governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Subject to any consumer rights or jurisdictional requirements that cannot legally be waived, the exclusive venue for a court proceeding arising out of or relating to these Terms or the Services shall be in Fulton County, Georgia.

Before initiating litigation, the parties agree to make a good-faith effort to resolve disputes informally.

If informal resolution is unsuccessful, the parties agree to attempt to resolve the dispute through mediation before pursuing other available legal or equitable remedies, except where emergency or injunctive relief is reasonably necessary or applicable law provides otherwise.

This section should be reviewed by legal counsel to confirm the appropriate governing law, venue, and dispute-resolution provisions for the business and its customers.


23. RECOVERY OF LEGAL EXPENSES

To the extent permitted by applicable law, if legal proceedings are required to enforce these Terms, a prevailing party may seek reasonable attorneys' fees and costs where such recovery is authorized by law or agreement.


24. SEVERABILITY

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.


25. NO WAIVER

Failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

Any waiver must be made expressly and does not constitute a continuing waiver unless expressly stated.


26. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without prior written consent.

I may assign rights and obligations associated with the Site or Services as part of a lawful sale, transfer, restructuring, succession, or other business transaction, subject to applicable law.


27. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any purchase-specific agreement, refund policy, membership terms, community guidelines, program agreement, or other terms expressly incorporated into them, constitute the agreement governing your use of the applicable Site and Services.

Where purchase-specific terms expressly conflict with these general Terms, the purchase-specific terms will govern that purchase to the extent of the conflict.
